GENERAL INFORMATION
The purpose of these General Terms and Conditions of Sale is the purchase of etching prints, linocuts, watercolors, reproductions, postcards and bookmarks via a telematic network on the website www.plumplumcreations.com, with registered office in Venice, Cannaregio 2681. Each purchase transaction will be governed by the provisions of DLgs. 185/99, DLgs. 206/05, the information aimed at the conclusion of the contract will be submitted to art. 12 of DLgs. 70/03 and, as regards the protection of confidentiality, will be subject to the rules of DLgs. 196/03.
CONCLUSION OF THE CONTRACT AND ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE
The contracts of sale of the products on the website www.plumplumcreations.com, are considered concluded at the time of receipt of the purchase order made by the customer to Plum Plum Creations and the latter accepts it. Plum Plum Creations will promptly send the customer receipt of the purchase order made by the customer.
By submitting his purchase order electronically, the customer declares that he has read and accepted these general terms and conditions and undertakes to observe and comply with them in his dealings with Plum Plum Creations.
PROCESSING OF PERSONAL DATA
Plum Plum Creations pursuant to art. 13 of Legislative Decree 196/2003 informs that personal and fiscal data acquired also verbally in reference to business relationships established, supplied directly by the interested parties, or otherwise acquired in the context of the company’s activity, will be processed in compliance with the aforementioned legislation, including the obligations of confidentiality provided for therein.
In relation to the aforesaid, the rights referred to in Article 7 of Legislative Decree 196/2003 may be exercised.
OBLIGATIONS OF THE CUSTOMER
The customer is required, before submitting his purchase order, to read carefully these general conditions of sale. The forwarding of the purchase order implies their full knowledge and acceptance.
ORDER DEFINITION
By sending the order online, the Customer sends Plum Plum Creations a proposal to purchase the product(s) placed in the shopping cart. When the Customer places an online order for the products he has placed in the cart, he agrees to purchase them at the price and at the terms indicated in these General Terms and Conditions of Sale.
Plum Plum Creations will communicate to the Customer the acceptance and confirmation of the order.
PURCHASING MODE
The customer purchases the product, whose characteristics are illustrated online in the relevant descriptions and techniques, at the price indicated to which are added the delivery costs specified on the site.
Before sending the purchase order, the unit cost of each product chosen is summarised, as well as the total cost in the event of the purchase of more than one product and the relative delivery costs.
Once the purchase order has been submitted, the customer will receive from Plum Plum Creations an e-mail message confirming receipt of the purchase order and containing information on the main characteristics of the goods purchased, a detailed indication of the price, delivery costs, applicable taxes and means of payment and containing a reference to the general conditions of contract and information about the existence of the right of withdrawal, the conditions and methods of its exercise displayed on the site.
PAYMENT
The customer can make the payment by choosing one of the following methods listed.
1. Payment by credit card or PayPal: If the consumer intends to make the payment by credit card, he can use the payment procedure through PayPal, suitable to ensure the confidentiality of data provided by customers. If the customer has a PayPal account, he can pay directly through his PayPal account, without using a credit card. For any information and further Legal Agreements, the Customer is invited to consult the website www.paypal.com.
2. Payment by Bank Transfer: In this case the products will be shipped only after payment has been received in the Plum Plum Creations account. The payment by bank transfer must done WITHIN 4 DAYS. The order will not be shipped until the money are transferred to Plum Plum Creations current account. If payment is not made within 4 days, the order will be cancelled.
DELIVERY OF PRODUCTS
The goods purchased, together with the relative invoice, are delivered by registered mail of the Italian Post Office to the address specified by the Customer at the time of ordering online.
Plum Plum Creations will ship the order as soon as possible, and in any case within 5 (five) business days. For deliveries in Italy Plum Plum Creations provides for the delivery of the goods usually within 5-6 (five-six) working days from the date of shipment.
For deliveries within the EU, delivery usually takes place within 7-9 (seven-nine) working days.
For deliveries outside the EU, delivery times can vary from 10 (ten) to 15 (fifteen) working days.
At the moment of the shipment of the product(s), Plum Plum Creations will send the Customer an email: a link and the tracking code will be provided to track the shipment.
It is the Customer’s obligation to ensure the delivery of the product(s): Plum Plum Creations is not responsible for any failure of delivery due to the absence of the recipient.
Plum Plum Creations is also not responsible for any damage caused to the product by the courier. If any damage should occur to the delivery, please inform Plum Plum Creations as soon as possible by sending an e-mail to info@plumplumcreations.com
WARRANTY OF CONFORMITY AND DIFECTED PRODUCTS
The products purchased on the website www.plumplumcreations.com are subject to the regulations on the sale of consumer goods. The products delivered comply with the characteristics illustrated online in the relevant descriptive and technical data sheets.
Please refer to the WORLD LIMITED WARRANTY for warranty terms.
RIGHT OF WITHDRAWAL
The consumer is entitled to exercise the right of withdrawal. In particular, the consumer has the right to withdraw from any contract concluded with Plum Plum Creations, without penalty and without giving any reason, within a period of 14 (fourteen) working days from receipt of the goods. The item –which must be perfectly intact and not damaged in any way– must be returned and shipped in conditions of safety similar to those used by Plum Plum Creations (padded envelope, protective cartons, bubble wrap, etc). Shipping costs are charged to the customer. Shipping costs are not reimbursed in any case. The refund will be made when the product(s) physically return to Plum Plum Creations.
The right of withdrawal is recognized by the consumer in relation to any goods purchased by him on the website www.plumplumcreations.com.
HOW TO EXERCISE THE RIGHT OF WITHDRAWAL
The right of withdrawal is exercised by sending a written communication to the email address of Plum Plum Creations within this period. In case of exercise of the right of withdrawal, the communication must be made to the following address: info@plumplumcreations.com
If the goods have been delivered, the customer must return them to Plum Plum Creations within 15 (fifteen) working days from the date of delivery of the goods.
The goods must be returned to Plum Plum Creations complete with all accessories and everything originally delivered to the customer, as well as packed in its original packaging. A copy of the order receipt must be attached to the returned product. The cost of returning the goods to Plum Plum Creations is borne by the customer.
If the right of withdrawal is exercised by the customer in accordance with the provisions of this clause, Plum Plum Creations is obliged to reimburse the amounts paid by the customer, excluding shipping costs.
In particular, Plum Plum Creations will proceed free of charge to the transmission of the order to re-credit the cost of the goods shipped, excluding shipping costs, within 30 (thirty) days from the date on which the goods are returned to Plum Plum Creations. This operation will be carried out through the credit institution issuing the credit card used for payment or by crediting the amount to the bank account indicated by the customer.
Plum Plum Creations has the right to reject any product returned in ways other than those specified above, as well as products for which the customer has not paid the full cost of return, or have not complied with the procedures and times specified for the communication of the exercise of the right of withdrawal.
EXPRESS TERMINATION CLAUSE
In the event of total or partial non-payment of the purchase price of the Plum Plum Creations property Plum Creations reserves the right to declare pursuant to art. 1456 of the Civil Code terminated this contract by sending a written notice to the customer’s e-mail address.

APPLICABLE LAW AND COMPETENT COURT
This contract is governed by Italian law. The exclusive jurisdiction and forum for any legal action brought by the Buyer pursuant to this warranty or any other legal warranty shall be the Court of Venice. In the event of a victory of Plum Plum Creations in any legal action, the plaintiff shall reimburse Plum Plum Creations for the costs, including attorneys’ fees and court costs.
For anything not expressly provided for in this contract, the current Italian laws shall apply.
